These Terms of Service ("Terms") govern your use of the Zevik platform operated by Zichron Capital Equity Pty Ltd (ACN 601 962 467, ABN 51 601 962 467) trading as Zevik ("we", "us", "our"). By using the Service, you agree to these Terms.

1. The Service

Zevik is an intelligent quote communication platform that allows businesses to upload quote documents, generate voice explanations, and deliver professional communications to their clients. The Service is provided via zevik.io and app.zevik.io.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. By using the Service, you represent that you meet these requirements.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@zevik.io if you suspect unauthorised access.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Upload documents that contain false, misleading, or fraudulent information
  • Send unsolicited communications to clients who have not consented to receive them
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Use the Service to send spam, harass, or harm any person
  • Resell or sublicense access to the Service without our written consent

5. Your Content

You retain ownership of all documents, data, and content you upload to the Service ("Your Content"). By uploading content, you grant us a limited licence to process and use Your Content solely to provide the Service to you. You are solely responsible for ensuring you have the right to upload and send the content, including obtaining any necessary consents from your clients.

6. Subscription and Payment

Zevik offers a free tier and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis in USD. All payments are processed securely through Stripe.

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through the billing portal
  • Refunds are at our discretion. We do not provide refunds for partial billing periods
  • We reserve the right to change pricing with 30 days notice

7. Intellectual Property

The Zevik platform, including its design, code, branding, and generated content systems, is owned by Zichron Capital Equity Pty Ltd. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary technology except as necessary to use the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will be accurate or suitable for any particular purpose. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Zichron Capital Equity Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunities. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Zichron Capital Equity Pty Ltd and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we discontinue the Service. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. AI-Generated Voice and Content

Zevik uses artificial intelligence technology, including AI-generated synthetic voice, to produce audio explanations of quotes on behalf of businesses using our platform. These audio explanations are not recorded by a human voice and are generated automatically based on quote content submitted by the business using our Service. All AI-generated audio content is clearly labelled on the client-facing page where it is delivered. By using the Service, you acknowledge and accept that client-facing audio explanations are AI-generated and you agree to ensure that any use of such content on your behalf complies with applicable laws, including the Australian Consumer Law.
